SMS Privacy & Terms

This page explains how First Class Auto handles mobile information and the terms of participating in our SMS and MMS text-messaging program. It supplements our Privacy Policy and Terms & Conditions, and the more protective messaging-specific restrictions here control over general sharing language.

Program operator and scope

First Class Auto LLC ("First Class Auto," "FCA," "we," "us," or "our") operates the First Class Auto text-messaging program. This page explains how we handle mobile information and the terms of participating in SMS or MMS communications. It supplements our Privacy Policy and Terms & Conditions. For mobile information, the more protective messaging-specific privacy restrictions in this page control over general sharing language.

Participation is voluntary. Consent to marketing is not required to buy a vehicle, receive an estimate, request collision or repair assistance, or purchase any other service.

Types of messages

Depending on your request and consent, we may send:

  • Responses to vehicle, service, collision, or sourcing inquiries.
  • Appointment requests, confirmations, reminders, and changes.
  • Requests for information needed for a repair or authorized transaction.
  • Repair, parts, claim-coordination, pickup, rental, or delivery updates.
  • Links to estimates, status pages, invoices, or secure document processes.
  • Customer-support follow-up and service feedback requests consistent with your permissions.
  • Promotional offers, inventory alerts, or other marketing only when separately authorized as required.

Consent for service-related texts is not automatically consent for unrelated marketing, other businesses' promotions, or AI-generated voice calls. The substance and purpose of a message, not merely its label, determine whether it is promotional.

Enrollment and consent

You may enroll by choosing a clearly described text-messaging option in a form, requesting texts through an approved interaction, or another lawful opt-in process. Marketing enrollment requires the applicable affirmative permission and disclosures. We may retain the wording presented, selected choices, source, date/time, number, and other evidence of consent.

Providing your number without the applicable consent action, accepting a general website policy, buying a vehicle, or being referred by someone else does not by itself authorize all categories of recurring texts. An inbound request may allow an appropriate response within its scope; it does not automatically enroll you in ongoing promotional messages.

You represent that you are the subscriber or authorized user of the number and can give the relevant permission. Do not enroll someone else's number without authority. If a number changes ownership or you lose access to it, notify us so we can update our records.

Automated and AI-assisted messages

Messages may be sent by employees or through automated platforms, including AI-assisted systems where enabled. AI may help answer routine questions, collect intake information, draft responses, route requests, and summarize conversations. An AI assistant is not a human employee, licensed technician, insurer, lender, or attorney.

AI-generated messages may contain mistakes. Confirm material prices, appointments, repair approvals, loaner arrangements, financing terms, and insurance information with our staff through the appropriate process. Texting with an assistant does not authorize it to make final lending or insurance decisions or bind an insurer.

You may request human assistance by replying with that request, calling (623) 281-3935, or emailing admin@firstclassautoaz.com. Human follow-up depends on staffed availability. HELP provides program assistance and does not necessarily transfer you to a live person immediately.

Frequency, cost, and availability

Message frequency varies with your inquiries, active transactions, and separately selected subscriptions. We do not promise a fixed number of messages unless the enrollment disclosure for a specific subscription says otherwise.

Message and data rates may apply. Your mobile provider's charges and plan terms govern. We do not charge a separate subscription fee merely for receiving the program's texts. Any vehicle, repair, rental, or other service charge is governed by its own agreement.

Delivery depends on carrier coverage, device settings, filtering, system availability, and other conditions. Messages may be delayed, duplicated, misdirected, or undelivered. Carriers are not liable for delayed or undelivered messages to the extent permitted by law. This statement does not waive any nonwaivable rights or excuse our own legal obligations.

STOP and other opt-out requests

Reply STOP to a First Class Auto text to unsubscribe. We also honor other clear, reasonable revocation requests, including customary opt-out terms such as QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT, as applicable. You may contact admin@firstclassautoaz.com or (623) 281-3935 to request that messages stop. You do not need to use an exclusive phrase or method where the law allows another reasonable method.

We process opt-outs as soon as practicable and within applicable legal deadlines. You may receive one non-promotional confirmation message where permitted. An unqualified STOP request removes the number from our recurring SMS program, including service and promotional texts; we will not switch you to another sending number to evade the request. A broader request to stop calls and texts is handled according to its scope and applicable law.

Unsubscribing does not cancel an existing repair, purchase, rental, payment obligation, or appointment. Coordinate necessary updates through another lawful available channel. We may retain limited information needed to document and honor your opt-out.

To resume texts, complete a new applicable opt-in process. Do not assume that an ordinary later inquiry automatically reinstates marketing consent. Where our system supports START, instructions may be provided, but renewed marketing permissions remain subject to the required disclosures and consent.

If you believe you received a message in error, tell us so we can correct our records. If a carrier blocks a reply or you cannot use the sending number, use the phone or email contact above.

Mobile information we collect and use

We collect the mobile number, information you supply in messages, associated customer or service details, consent and opt-out records, message timestamps, delivery and response data, and operational metadata supplied by messaging providers. Where a message includes a link, the linked service may collect technical information as described in our Privacy Policy.

We use this information to deliver and support the program, respond to requests, maintain service records, manage preferences, prevent misuse, improve message accuracy and operations, and satisfy legal requirements. AI-assisted processing and any provider training or reuse are described in the Privacy Policy; participation does not grant unrestricted rights to reuse conversations for unrelated purposes.

No sale or third-party marketing sharing of mobile information

We do not sell or rent your mobile phone number. We do not share mobile information with third parties or affiliates for their own marketing or promotional purposes. Text-messaging originator opt-in data and consent are not shared with third parties for their own use.

We may provide limited access to messaging platforms, telecommunications carriers, customer-support providers, and other vendors solely as needed to deliver and support our program on our behalf, subject to appropriate restrictions. Such access is not permission for independent marketing, list building, or unrelated reuse.

We may disclose information when legally required or reasonably necessary to protect legal rights, address fraud or security, or comply with a lawful process. A transfer of business assets does not eliminate these restrictions or expand your consent. General referral arrangements do not grant another business access to SMS opt-in data for its own campaigns.

Message confidentiality and security

SMS and MMS are not guaranteed secure or confidential. Messages may be visible on a lock screen, shared device, carrier system, or reassigned number. Do not text Social Security numbers, full payment card numbers, bank credentials, passwords, detailed medical information, or identity documents unless directed to an appropriate secure process rather than ordinary SMS.

Private tracker or document links should not be forwarded to unauthorized people. Contact us using a verified channel if a payment request or message seems suspicious. We will not treat possession of a phone alone as adequate verification for every sensitive request.

Retention and privacy requests

Messages and related records are retained according to our legitimate service, legal, security, and recordkeeping needs as described in the Privacy Policy. Consent evidence and suppression records may be retained to document permissions and prevent unwanted future contact.

You may submit applicable privacy requests using the contacts above. Deleting a customer record does not necessarily require deleting the minimal suppression record needed to honor STOP. We do not unlawfully discriminate against people who exercise their privacy rights.

Appropriate use and emergencies

Do not use the program to harass, threaten, impersonate another person, submit fraudulent information, send malicious content, or disclose information you lack authority to provide. Enrollment is intended for adults able to authorize the relevant communications.

Text messaging is not an emergency channel and is not continuously monitored by human staff. Call 911 for an immediate threat to life or safety. Do not text while driving. Do not rely on a text response to determine whether a damaged vehicle is safe to drive.

Program changes

We may change or discontinue a messaging feature subject to applicable law and existing obligations. Material changes to consent scope require any additional notice or permission required by law. Posting revised terms does not enroll you in new marketing categories, override an opt-out, or transfer consent to unrelated businesses.

Other terms and consumer rights

The general Terms & Conditions apply to relevant digital interactions, but they do not override the mobile privacy protections or opt-out rights in this page. Nothing here waives claims or remedies that cannot lawfully be waived under privacy, consumer-protection, telecommunications, or other applicable law.
